Frequently Asked Questions
Do you have to pay sales tax at flea markets?
It depends on the kind of flea market.
Legally, yes, sales tax is required by law.
Dealers must get a business license and pay taxes to the state on what they sell.
At flea markets where individuals are selling things, business is done on a cash basis.
They may not charge you a sales tax, and it is up to them to take care of the taxes.
If it is a cash transaction, there is no record, so it can get shady.
Flea markets that are open daily and inside buildings are usually more formal in their business dealings and you are likely to get charged a sales tax there.
How is a flea market like a swap meet?
The traditional flea market is an outdoor area where people can set up tables and such and sell things they have brought.
This could be anything.
It is very informal, prices are often negotiated, and deals are made on the spot.
Some people like going just to take part in that bartering.
Often the listed price is just a suggestion and it depends on how badly the dealer wants to sell the item.
You may also swap items at these places instead of using cash transactions.
How is an indoor flea market different than an outdoor one?
Often, the indoor flea market has booths that are rented by dealers on a contract basis.
The owners of the booths are not there.
The person running the flea market takes care of all the sales.
Usually, there is no negotiation of prices and it is more like a regular store.
A traditional flea market can be held indoors and the owners are there selling their goods.
The other type of market has the store selling for individuals.
How can I sell stuff at a flea market?
The informal outdoor swap-meet type market usually has a quick application form and a small fee attached.
The cost is usually small, less than $50, and often around $20.
The more formal indoor market has a booth set up for you to place your wares.
The cost is generally higher and is paid on a monthly basis.
The store may also get a small percentage of your sales.
What should you be careful about when attending a flea market?
Keep in mind the old saying, “buyer beware.”
This is a cash business.
There are no warranties and all sales are final.
There is no guarantee that what you are buying is authentic.
Examine items carefully because if you later find out it is broken or damaged, there is nothing you can do about it.
But even in saying that, they are still a lot of fun to go to and you can find some good deals.
Just be aware that if something seems too good to be true, it is likely, not true.
